Create an account. In order to use certain services, you may need to create an account. The arbitrator may, on an individual basis, award the same damages and compensation as a court, only for or against the parties to the arbitration, including monetary damages, injunctive relief, and declaratory relief, and only to the extent necessary to provide relief justified by that party`s individual claim. In no event may the arbitrator preside over a class action or class action. Regardless of how the arbitration is conducted, the arbitrator shall issue a reasoned written decision sufficient to explain the significant findings and conclusions on which the award is based. The award shall be binding only between the parties to the arbitration and shall have no exclusionary effect in any other arbitration or proceeding involving another party, provided that the arbitrator may consider decisions in other arbitrations involving different persons. The arbitrator`s award may be entered in any court of competent jurisdiction. A single arbitrator of the American Arbitration Association (“AAA”) will conduct the arbitration, and the amount and manner of the award will not exceed the remedy permitted by applicable law.

The arbitration will take place in your district of residence or other mutually agreed location. The AAA`s Consumer Arbitration Rules apply as modified by this Dispute Resolution/Arbitration Agreement. If AAA does not enforce these rules, the AAA`s Commercial Arbitration Rules as modified by this arbitration agreement apply. The AAA Rules and a form that can be used to initiate arbitration are available at www.adr.org. You and Freestyle Snacks agree that the parties shall agree to an alternative arbitration body if, for any reason, AAA will not conduct the arbitration or is no longer available. If the parties fail to reach an agreement, they shall apply to each other court of competent jurisdiction to appoint an arbitration body to conduct the proceedings in accordance with the provisions of this arbitration agreement.
